Costs of a patent application, trademark application, or design application
Patent application / utility model
First, we recommend contacting us briefly by phone so that we can “sort out” the relevant issues.
Roughly speaking, the costs for a German patent application start at approx. €3,300, while a (more territorially extensive) European EP patent application costs approx. €5,600. We would be happy to compile the costs for other national applications (e.g., internationally as PCT, or individually, e.g., for the USA, Canada, Japan, France, etc.) if required (comparable to EP in the application phase).
In order to save costs in the subsequent examination procedure at the patent office, it is always advisable to carry out a so-called:
Novelty search in patent databases (here at the law firm). This not only offers the advantage of finding any hits in the prior art that could be detrimental to novelty.
Above all, your patent application will be better if you can already distinguish it from the known state of the art when formulating it.
At the end of the novelty search, you will also have an idea of the possible scope of protection.
This step-by-step approach is very useful for utilizing costs as effectively as possible.
Experience shows that the (optional) novelty search costs between EUR 1,600 and EUR 2,100 (optional).
The WIPANO subsidy may also be of interest (50% subsidy).
Please contact us if you have any questions.
Trademark application
The costs of a trademark application vary depending on the fees payable to the respective trademark office (official fees) and the fee payable to the attorney or patent attorney commissioned with the trademark application, if applicable.
Trademark application at the DPMA
DE trademark at the German Patent and Trademark Office
The official fees for a German application at the German Patent and Trademark Office amount to €300.00, provided that the list of goods and services does not contain more than three classes (the DPMA charges €100.00 for each additional class).
Application at the EUIPO
Application for a European Union trademark (EU trademark)
The European Union Intellectual Property Office (EUIPO) charges €850 for the registration of a Union trademark for the first class of goods and services, an additional €50 for the second class, and €150 for the third and each additional class.
Registration with WIPO
Registration of an international trademark (IR trademark)
The basic fee for registering an international trademark (IR trademark) with WIPO in Geneva is 653.00 Swiss francs (CHF) if a word mark is to be registered (or the LOGO is to be displayed in black and white) and 900.00 Swiss francs (CHF) if a colored figurative mark or word and figurative mark is to be registered. In addition, there are individual fees charged by the various Madrid Contracting States.
